Booking of BitaCarsVehicle

The Users may choose from the vehicles which are available on the Website or BitaCars Application for the purpose of booking a Vehicle. At the time of booking, the Users will be required to: Select the BitaCars Vehicle as per their requirements Provide the start and end date and time, indicating the duration for which the BitaCars Vehicle will be required for use by the User;Provide the details of the address where the vehicle needs to be delivered to the User, and where he will return the vehicle Pay the Fees for use of the Vehicle through any of the payment systems that BitaCars is using atthat point of time.
● If a user wishes to cancel a reservation or shorten the length for which a vehicle has been reserved, he need to do so earlier, as mentioned in the price rental fee policy
●If user wants extension or reservation, he can also do it with BitaCars Application, or the help of BitaCars helpdesk executive by informing him on call or whatsappFor this, the user will have to inform at least 24 hours before.
●the BitaCars Vehicle is available for use for the extension period (for example, it is not reserved by another User); andUpon payment of Fees in advance for such extended period.
●If a User want to extend a reservation, So user can do this anytime through the application such User is required to communicate request for extension to BitaCars prior to the timeline outlined in the Fee Policy. BitaCarsshall have the sole discretion to allow such extension or refuse the same. A request for extension will only be permitted where:

Refundable safety deposit
Refundable security deposit of up to Rs 5000 may be charged. it will likely be refunded in 7 days of booking and time. We provide many pricing plans to suit your requirements. each pricing plan differs in phrases of "Kilometers limit".

Eligibility for take a vehicle
 Candidate must be 24 years of age or older who want to rent a vehicle  Candidate must possess a valid driving license and Aadhaar card or Passport  Members must have had never alcohol or drug related driving violations  All payment mode accepted here.

Refund and Cancellation
Valid Refund will be initiated in your account with 24 hours from the payment time in your account. You can cancel your booking anytime and get your refund in 24 hours.Please note that refund will be made after deducting any due charges and damages to any of our assets such as vehcile and its parts by you.

Enrollment as User
By accepting these Terms and Conditions, the User has agreed to enroll as a User under the Scheme to avail the facility for rental of BitaCars Vehicles. The User further acknowledges and understands that he/she shall not at any time challenge any of the provisions of these Terms or the contents of the Website on the premise that the terms and conditions have not been read by the User or that the User is not aware of the enrollment formalities or that the User has not understood any provision of these Terms or the procedures, formalities, benefits rights and/or obligations as contained on the.

Summary
Unless the context or meaning thereof otherwise calls for, the subsequent expressions shall have the meanings assigned to them hereunder:

Extra Kilometer
Driven shall include any additional Kilometer(s) (“ KM ”) driven on the Vehicle booked by the User beyond the KMs which were reserved and paid to BitaCars by the User. The User shall be liable to pay the additional cost for driving the Vehicle beyond the KMs approved and paid as per the Fee Policy of the Company.

Tracking Devices
Manner and includes the numerous device selected by way of BitaCars to be mounted in the vehicles for the safety, protection, monitoring and tracing monitoring of the vehicles.

Motor Vehicles Act,
Means the Motor Vehicles Act, 1988 along with the rules prescribed thereunder and includes any statutory modifications or re-enactments thereof and the applicable provisions, if any, of the Motor Vehicles Act, 1988 as amended, modified and re-enacted from time to time.

Booking Time
Means the specific period for which the User has made the Booking for usage against the Booking fees, pursuant to terms of this Agreement.

Vehicles
The self-drive vehicle at the website or application for rent, that is reserved by means of the user for a selected duration, as in line with the terms of this agreement.

Commercial and Running Terms & Condition
Scope of vehicle rental services provided by BitaCars.
●Upon payment of the fees in advance, BitaCars is responsible to provide the following services to the User: Provide the vehicle model booked by the User, at the preferred time and location, as specified at the time of making the booking.
●In case there is a delay or due to any unfortunate event BitaCars has to cancel the booking of the User, BitaCars is liable to compensate / provide a refund to the User for the part where the service could not be provided.
●make certain the automobile being supplied to the person is in precise circumstance and is properly maintained, as consistent with the prescribed protection schedule of the car OEMs
●In the unfortunate event when there is a breakdown of the vehicle, while being used by the User, and it is clearly established that the breakdown was due to a mechanical / electrical failure of the vehicle and not due to any consequential or driving behaviour related damage caused by the User, BitaCars will try and provide the best resolution possible to the User. This resolution will include providing a replacement vehicle, if the vehicle is within 2 hours of driving distance from any of BitaCars hubs, arranging for an RSA (road side assistance) and/or any other help that might be needed by the User.


User permissions to rent BitaCarsVehicles
●The BitaCars Vehicles shall be provided on rental basis only to eligible Users. Notwithstanding anything stated herein, BitaCars shall have the sole discretion to refuse to provide any BitaCars Vehicle to any Users.
●Users shall ensure that the BitaCars Vehicles shall not be driven by, or provided for use to, any person whose eligibility has not been deemed as valid by BitaCars.
(1). The Reserving User shall provide the details of the Non-Reserving User to BitaCars;
(2). The Reserving User shall not be allowed to provide the BitaCars Vehicle to a Non- Reserving User for any commercial purpose;
(3).The Reserving User shall continue to be responsible and liable to BitaCars to ensure that all terms and conditions as set out in these Terms are complied with by the Non- Reserving User.
(4).The Reserving User shall further ensure that the information pertaining to the Non- Reserving User shall remain updated in the records of BitaCars till such time as the BitaCars Vehicle is being used by such Non-Reserving Users
(5).The Reserving User shall continue to remain liable to BitaCars for due compliance of all terms and conditions as set out in these Terms including for payment of all fees and charges associated with the usage of the BitaCars vehicles.

Prohibited Use of BitaCars Vehicles

Users shall not be permitted to use the BitaCars Vehicles under the following conditions and/or for the purposes mentioned hereunder. These examples are not intended to be exhaustive. Any unreasonable or inappropriate use of a BitaCars Vehicle, as determined by BitaCars in its sole discretion, may be deemed a violation of these Terms and Conditions:
(1). For any speed race or competition;
(2). For the purpose of towing, pushing, or propelling any trailer or any other vehicle;
(3). By any person who is under the influence of (i) alcohol or (ii) any drug or medication under the effects of which the operation of a vehicle is prohibited or not recommended;
(4). Illegal Nature: -For the purpose of commission of any crime or other illegal or unlawful activity;
(5). In an imprudent, negligent, abusive way or for any peculiar use of the BitaCarsVehicles;
(6). By any person who has provided BitaCars with false information (including, without limitation, any personal information such as name, age, or address) or whose representations are determined to be false;
7. For the purpose of driving outside the territorial boundaries of India or any prohibited areas within territory of India;
(7). Driving while using a mobile phone or any other mobile communication device in any manner whatsoever, including while sending an SMS, emailing, using a cell phone with or without a hands- free device, otherwise using a mobile communication device or engaging in similar activities that may be prohibited under Applicable Laws;
(8). For the purpose of transportation of any goods including any flammable, poisonous, or otherwise hazardous substances;
(9). Or the purpose of transporting objects that could – due to their size, shape, or weight – adversely impact the vehicle’s handling safety or that could damage the interior of the BitaCars Vehicle or, by virtue of such object/s protruding outside, affect the safety of vehicles driving in the vicinity of the BitaCars Vehicle.
(10). Carrying more than the authorized number of persons (equal to the number of seat-belts) in the BitaCars Vehicle.
(11). Use of tobacco, drugs or psychotropic substances inside BitaCars Vehicles is absolutely PSrohibited. Users are subject to payment of penalties if evidence of smoking, chewing, or dipping is found in BitaCars Vehicle.
(12). Hazardous Nature: - Burning any substance including tobacco, incense etc. inside BitaCars Vehicles is absolutely prohibited.
(13). Animals are prohibited in Revv Vehicles. Users are subject to payment of penalties in the event it is determined that the BitaCars Vehicles have been used for transportation of animals.
(14). A BitaCars Vehicle cannot be taken inside Leh/Ladakh region and Kaza/Nako region.
(15). Any kind of activity by any person which will affect the normal conditions of the vehicle

Safety & Security

(A).The User is responsible for
●Complying with all applicable laws including seat belt, speed limit and child restraint laws. It is being made crystal clear that the User must abide with the maximum speed/ weight limit and any other instructions being displayed/ communicated by the authorities through marks or sign boards at various locations of the concurrent trip.
●Protecting all children by proper use of any child passenger restraint system that complies with the motor vehicle safety standards in the jurisdiction where the trip is initiated and where the Vehicle is driven during such trip.
●Each time the User parks a Vehicle (either at the end of the Booking Period or during the Booking Period), the User shall be responsible for securing the Vehicle in conditions such as closing of windows and locking the car.

(B).Security of Vehicle
●Each time the User parks the Vehicle (either at the end of the or during the Booking Period), the User shall be responsible for securing the Vehicle from external factors including human or general known adverse weather conditions.
●(Windows must be closed, and the central locking system must be enabled using the smart phone app or the SMS command). If the Vehicle is outside of cell phone range, and the Vehicle cannot be locked through the phone command system, the User must remove the key and lock the Vehicle manually. The User will be responsible for any fees or charges associated with a failure to perform these steps.
●BitaCars encourages all its Users to take full responsibility for their belongings. In case of any User claims to have left back any luggage or any phones or personal music devices inadvertently in the Vehicle after the User completes his/her Booking, Bitacars shall endeavour to locate the lost belongings on a “best-effort” basis provided the User notifies BitaCars of the same within 30 minutes of the successful return of the Vehicle post completion/termination of the Booking, but BitaCars shall not be held responsible for such loss or damage in any circumstances.

(C)Fee & Eligible (Reimbursable) Expenses.
●The User is subject to the fees policy mentioned on the Website (“ Fee Policy ”). The Fee Policy covers all the fees, costs, penalties, and expenses including but not limited to rentals, Excess Kilometre driving charges, damage fee, late payment fee, extensions fees, penalties or fines, if any etc.
●In the event of any issues or damages to the Vehicle, the User shall report the same to Us and We shall get the same fixed. In the event any issues or damages need urgent repair or fixing (such as outstation cases), the User can get the same fixed upon obtaining prior approval to Us. If a User pays for any Eligible Expense in relation to repair or fixing the Vehicle, he or she must keep the invoice which is subject to fuel test more particularly mentioned in the Fee Policy, which conspicuously captures the date and time showing that it was incurred during the Booking Period. The User must print his or her name on such invoice and provide a physical original hard copy of the same to Our Vehicle attendant upon handover of the Vehicle in terms of this Agreement. Zoomcar will reimburse the User or credit the User’s account, post the verification of claim and corresponding invoices, and would be settled in the monthly invoice. No reimbursement or credit will be given without an invoice, or if the invoice is submitted later than 3 days from the invoice date. The User hereby agrees and acknowledges that it will be reimbursed as per this Clause only in case of Eligible Expenses incurred by it.
●For the purpose of this Agreement, ‘ Eligible Expense’ means: (i) any fuel related expense for the Bookings with fuel, provided it reconciles reasonably with distance travelled; in pursuance of the standard industry mileage or BitaCars r’s internal mileage standard; or (ii) an expense incurred by the User for any maintenance of the Vehicle, such as new wiper blades, light bulbs, or windshield-washer fluid, etc. that is authorized in advance by a BitaCars Representative, via e- mail/SMS/phone.
